This is a fast path to open source irrelevancy, since the US copyright office has deemed LLM outputs to be uncopyrightable.

This is a misunderstanding of US Copyright. Here’s a link to the compendium so you can verify for yourself.

Section 313 says “Although uncopyrightable material, by definition, is not eligible for copyright protection, the Office may register a work that contains uncopyrightable material, provided that the work as a whole contains other material that qualifies as an original work of authorship…”

This means that LLM created code that’s embedded in a larger work may be registered.

Section 313.2 says “Similarly, the Office will not register works produced by a machine or mere mechanical process that operates randomly or automatically without any creative input or intervention from a human author.”

Meaning that LLM created code CAN be registered as long as an author has some creative input or intervention in the process. I’d posit that herding an LLM system to create the code definitely qualifies as “creative input or intervention”. If someone feels it isn’t then all they need to do is change something, literally anything, and suddenly it becomes a derivative work of an uncopyrighted source and the derivative can then be registered (to a human) and be subject to copyright.

This isn’t a “checks and balances” thing. The Governor of Minnesota has the authority to order actual military firepower, like tanks and helicopters, to maintain order at the facility.

The State of Minnesota has its own force capabilities. Tim Walz could ring the facility with State Guard, order tanks to sit in the parking lot, and have combat helicopters flying over the facility 24x7. THAT is how its stopped. The State of Minnesota isn’t a Court, it actually has the ability to enforce things using military firepower.

This isn’t a matter of “following the proper protocol” it’s that there is NO protocol. The action is specifically prohibited by law and is enforceable by a political enemy of President Trump. People comment about “A court has no ability to enforce it’s decisions.” but in this case it’s a STATE and they DO have the ability to enforce a decision.

There ISN’T a mechanism, it simply doesn’t exist. Trump can write the pardon if he wants but it would be meaningless. It wouldn’t remove the conviction, wouldn’t end his sentence, and wouldn’t effect his release.

It’d be like Germany issuing a pardon for someone convicted of a crime in Spain and trying to order them released. They can issue the pardon and make the order but there’s absolutely no way to enforce it short of direct military action.

I’m failing to see a mechanism where a Federal Pardon for State charges would result in Tim Walz letting this guy out of prison. What are they going to do? Send the US Military over and attack the place?

What you are describing is completely absurd. It’s beyond hyperbole.
